For how long are the collected personal data retained?

The personal data provided will be kept for as long as the commercial relationship is maintained or until you request its deletion, and for the period during which legal responsibilities may arise from the services provided.

Data retention in accordance with the LSSI

Mecanizados Basauri, S.L. informs that, as a data hosting service provider and in accordance with the provisions of Law 34/2002 of July 11 on Information Society Services and Electronic Commerce (LSSI), retains for a maximum period of 12 months the essential information to identify the origin of the hosted data and the moment when the service provision began. The retention of this data does not affect the confidentiality of communications and may only be used within the framework of a criminal investigation or for the safeguarding of public security, being made available to the judges and/or courts or to the Ministry requiring them.

The communication of data to the State Security Forces and Bodies will be made in accordance with the provisions of the regulations on the protection of personal data.

Intellectual Property Rights

Mecanizados Basauri, S.L. holds all copyrights, intellectual property, industrial, know-how, and any other rights related to the contents of the website www.mecabas.es and the services offered therein, as well as the programs necessary for its implementation and related information.

Reproduction, publication, and/or non-strictly private use of the contents, in whole or in part, of the website www.mecabas.es is not permitted without prior written consent.

Intellectual Property Rights of the Software

The user must respect third-party programs made available by Mecanizados Basauri, S.L., even if they are free and/or publicly available.

Mecanizados Basauri, S.L. holds the exploitation rights and necessary intellectual property rights of the software. The user does not acquire any rights or licenses for the contracted service, over the software necessary for the provision of the service, nor over the technical information for monitoring the service, except for the rights and licenses necessary for the fulfillment of the contracted services and only during their duration.

For any action that exceeds the fulfillment of the contract, the user will need written authorization from Mecanizados Basauri, S.L. The user is prohibited from accessing, modifying, viewing the configuration, structure, and files of the servers owned by Mecanizados Basauri, assuming civil and criminal liability for any incidents that may occur on the servers and security systems as a direct result of negligent or malicious actions on their part.

Intellectual Property Rights of Hosted Contents

The use contrary to intellectual property legislation of the services provided by Mecanizados Basauri, S.L. is prohibited, in particular:

Use that is contrary to Spanish laws or infringes the rights of third parties.
Publication or transmission of any content that, in the judgment of Mecanizados Basauri, S.L., is violent, obscene, abusive, illegal, racial, xenophobic, or defamatory.
Cracks, program serial numbers, or any other content that violates the intellectual property rights of third parties.
Collection and/or use of personal data from other users without their express consent or in contravention of Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27, 2016, regarding the protection of individuals with regard to the processing of personal data and on the free movement of such data.
Use of the domain’s mail server and email addresses for sending unwanted mass emails.

The user is solely responsible for the content of their website, the information transmitted and stored, hypertext links, third-party claims, and legal actions regarding intellectual property, third-party rights, and the protection of minors.

The user is responsible for compliance with current laws and regulations and rules related to the operation of the online service, e-commerce, copyright, maintenance of public order, as well as universal principles of Internet use.

The user will indemnify Mecanizados Basauri, S.L. for any expenses incurred by Mecanizados Basauri, S.L. in any proceedings for which the user is responsible, including legal fees and defense expenses, even in the case of a non-final judicial decision.

Protection of Hosted Information

Mecanizados Basauri, S.L. performs backups of the contents hosted on its servers; however, it does not assume responsibility for the loss or accidental deletion of data by users. Similarly, it does not guarantee the complete replacement of data deleted by users, as such data may have been deleted and/or modified during the time elapsed since the last backup.

The services offered, except for specific backup services, do not include the replacement of contents stored in backups made by Mecanizados Basauri, S.L., when this loss is attributable to the user. In this case, a fee will be determined based on the complexity and volume of the recovery, always subject to user acceptance.

The replacement of deleted data is only included in the service price when the loss of content is due to causes attributable to Mecanizados Basauri, S.L.

Commercial Communications

In accordance with the LSSI, Mecanizados Basauri, S.L. will not send advertising or promotional communications via email or any other equivalent electronic means unless they have been previously requested or expressly authorized by the recipients.

In the case of users with whom there is a pre-existing contractual relationship, Mecanizados Basauri, S.L. is authorized to send commercial communications regarding products or services of Mecanizados Basauri, S.L. that are similar to those initially contracted with the client.

In any case, the user, after proving their identity, may request not to receive any more commercial information through the Customer Service channels.
